Welcome to Stay Realm ("Company", "we", "us", or "our"). These Terms of Service ("Terms") dictate and regulate your access to and use of our proprietary global accommodation booking platform, including our website, mobile applications, APIs, and associated concierge services (collectively, the "Services"). By explicitly accessing, browsing, registering an account, or conducting any transaction through the Services, you unequivocally agree to be bound by these Terms, along with our Privacy Policy and Cookie Policy, which are incorporated herein by reference.
If you do not entirely agree with any provision of these Terms, you are explicitly prohibited from accessing or utilizing the Services. We reserve the absolute right to unilaterally update, modify, or replace these Terms at any time at our sole discretion. Any material modifications will be communicated via email or through a prominent notice on the platform. Your continued utilization of the Services following the posting of any changes constitutes your irrevocable acceptance of those changes.
Stay Realm operates exclusively as a digital intermediary and technology platform. We facilitate connections between travelers ("Guests") and accommodation providers ("Hosts", "Hotels", "Properties"). We do not own, manage, lease, or directly operate any of the properties listed on our platform. Consequently, when you make a reservation, you are entering into a direct, legally binding contractual relationship with the respective accommodation provider.
Our role is strictly limited to providing the technological infrastructure to aggregate global inventory, process your search queries, transmit your reservation details to the applicable property, and facilitate the secure processing of your payment on behalf of the accommodation provider. We accept no liability for the physical condition, safety, regulatory compliance, or precise accuracy of the property descriptions, though we employ rigorous vetting algorithms to ensure high quality standards across our network.
To access exclusive inventory and utilize our concierge services, you must register a User Account. You guarantee that all information provided during registration is accurate, current, and exhaustively complete. You are solely and absolutely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to immediately notify Stay Realm of any unauthorized use of your account or any other breach of security. We categorically disclaim any liability for losses or damages arising from your failure to safeguard your credentials. You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to create an account and execute binding legal contracts through our platform.
By clicking "Confirm Booking," you authorize Stay Realm, via our PCI-DSS compliant third-party payment processors, to charge the total designated amount to your provided payment method. Prices displayed on our platform are highly dynamic and subject to real-time fluctuations based on market demand, global currency exchange rates, and property-specific algorithmic pricing models.
All prices are explicitly inclusive of applicable local taxes and standard service fees unless legally required otherwise in specific jurisdictions. However, certain municipalities mandate local city taxes, resort fees, or environmental levies that must be collected directly by the property upon check-in. We strive to display estimated local fees, but cannot guarantee their absolute precision due to shifting local ordinances.
In the event of an egregious pricing error—defined as a rate discrepancy so obvious and profound that it could not reasonably be interpreted as a legitimate offer—Stay Realm reserves the right to unilaterally cancel the reservation, refund all monies paid, and assist the Guest in securing alternative accommodations at the correct market rate.
Cancellation policies are dictated entirely by the individual accommodation provider and are clearly presented during the checkout process. By finalizing a reservation, you explicitly agree to the specific cancellation and no-show policies attached to your selected rate. "Non-Refundable" rates are strictly ineligible for refunds under any circumstances, barring mandatory statutory protections in your specific jurisdiction.
If you wish to modify your reservation dates or room types, such requests are subject to property availability and may incur rate increases or modification fees. Stay Realm does not charge modification fees, but the property provider may. In the exceedingly rare event that a property is forced to cancel your confirmed reservation due to overbooking or force majeure, our Global Concierge team will immediately intervene to secure alternative accommodations of equal or superior standing, or process a full, expedited refund.
You agree to conduct yourself in a respectful, lawful, and appropriate manner during your stay. You are bound by the specific House Rules and regulations established by the accommodation provider. Any severe violation of these rules—including but not limited to excessive noise, property damage, illegal activities, or exceeding the maximum occupancy limits—grants the accommodation provider the immediate right to terminate your reservation and evict you without any obligation to refund unused nights.
You are financially liable for any damages caused to the property by yourself, your guests, or your invitees. Stay Realm reserves the right, upon receiving documented evidence from the property, to charge your payment method on file for reasonable repair or replacement costs associated with such damages.
The entirely of the Stay Realm platform—including its underlying source code, algorithmic pricing models, visual interfaces, graphics, editorial content, and trademarks—is the exclusive property of Stay Realm Ltd. and is fiercely protected by international copyright, trademark, and trade secret laws.
You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the platform solely for its intended purpose of booking travel. You are explicitly prohibited from scraping, data-mining, reverse-engineering, or deploying automated bots to extract inventory data or pricing information from our servers. Any unauthorized reproduction or distribution of our intellectual property will result in immediate legal action.
To the maximum extent permitted by applicable law, Stay Realm Ltd., its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of your access to, use of, or inability to use the platform or services.
Furthermore, we assume absolutely no liability for physical injury, property damage, theft, or emotional distress sustained during your stay at any booked property. Your recourse for any such grievances lies exclusively with the accommodation provider or local law enforcement. In no event shall our aggregate liability to you for all claims exceed the total amount you paid through the platform in the twelve (12) months preceding the incident giving rise to the claim.
In the interest of resolving disputes efficiently, you and Stay Realm agree that any claim or controversy arising out of or relating to these Terms shall be settled by binding arbitration, rather than in a court of general jurisdiction. Arbitration shall be administered confidentially by the International Chamber of Commerce (ICC) under its Comprehensive Arbitration Rules and Procedures.
You explicitly waive any right to participate in a class action lawsuit or class-wide arbitration. The arbitrator may not consolidate more than one person's claims. If this specific class action waiver is found to be unenforceable, the entirety of this arbitration provision shall be null and void, and the dispute shall be resolved in a court of competent jurisdiction.
These Terms and your relationship with Stay Realm shall be governed by and construed in accordance with the laws of the Republic of Ireland, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Dublin, Ireland, for the resolution of any disputes not subject to the binding arbitration clause above.
If any provision of these Terms is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and Stay Realm regarding our Services, superseding any prior agreements or understandings.
